Superannuation clause review in Modern Awards

On 26 March 2024, the Fair Work Commission issued determinations varying superannuation clauses in 147 modern awards to reflect current superannuation requirements.

The changes include reference to the National Employment Standards (NES) which now deals with superannuation rights and obligations. 

As of 1 January 2024, employees covered by the NES can take court action for any unpaid superannuation under the Fair Work Act 2009 unless the ATO has already commenced legal proceedings to recover the same superannuation. 

The new NES entitlement to superannuation now correlates with superannuation legislation. This means that an employers can be reassured that if they are complying with their obligations under superannuation legislation, they are also complying with their obligations under the NES.

These changes take effect on the first full pay period on or after 9 April 2024.

Increase to Superannuation Guarantee

Employers should also be aware that the next increase to the Superannuation Guarantee will be from 1 July 2024 which will see another .5% increase to the compulsory superannuation contribution employers need to make. From 1 July 2024 the Superannuation Guarantee will increase to 11.5%. The Superannuation Guarantee is scheduled to be increased by .5% every year until it reaches 12% on 1 July 2025.
